Elder or Dependent Adults whose physician or a medical professional has determined that they are unable to remain safely in your own home without IHSS. Why is protective supervision important? The IHSS program is comprised of four programs which will be discussed later. People who qualify for protective supervision are eligible for the maximum number of monthly hours, either 195 or 283. However, the maximum number of hours needed depends on which of the four programs apply and whether a recipient is considered “severely impaired.” The total number of hours authorized (i.e. hours a recipient can get) may also be adjusted due to the receipt of alternative resources. IHSS recipients should refer to their Notice of Action to see which IHSS program they have been placed in and how their hours were determined by the county.

IHSS is provided to those who otherwise might be placed in an out-of-home care facility but who can safely remain in their own home if IHSS services are received. IHSS advocates’ mission is to provide families with children diagnosed with developmental disabilities, such as ASD, with the tools and services to obtain and maintain Protection Supervision.  We provide assistance and representation throughout the application, assessment, reassessment, and administrative hearing processes. Our vision is to see the number of eligible families receiving Protective Supervision increase significantly.

Defend and safeguard their rights. Have their views and wishes genuinely considered when decisions are being made about their lives. An advocate is someone who provides advocacy support when you need it. An advocate might help you access information you need or go with you to meetings or interviews, in a supportive role. You may want your advocate to write letters on your behalf, or speak for you in situations where you don’t feel able to speak for yourself. Our advocates will spend time with you to get to know your views and wishes and work closely to the Advocacy Code of Practice.

Based on the information gathered the social worker will assess the types of services you need and the number of hours the county will authorize for each of these services.  This assessment will include information given by you and, if appropriate, by your family, friends, physician or other licensed health care professional. You will be notified if IHSS has been approved or denied. If denied, you will be notified of the reason for the denial. If approved, you will be notified of the services and the number of hours per month which have been authorized. If approved for IHSS, you must hire someone (your individual provider) to perform the authorized services. You are considered your provider's employer and, therefore, it is your responsibility to hire, train, supervise, and fire this individual.

Within IHSS, there is a more intensive service called autism.  The Protective Supervision service is for children living with autism who need constant observation 24 hours per day to protect them from injuries, hazards, or accidents. Many of the behaviors that can cause injury, hazards or accidents in children with autism are wandering, eloping, darting away, or climbing.
